This article contains some opinions stated as facts and reflects a certain amount of political bias. Amendment 41 has been criticized by knowledgeable persons from different political parties due to its broad prohibitions, poorly chosen wording, and uncertain application and outcome. A commission has been established to adjudicate alleged violations, and may take into account the nexus, or lack thereof, between a challenged gift and the recipient's government employment.

This article is several years out of date and does not reflect many developments.
