Bankruptcy liquidations[edit]

I am not a lawyer, so what I write can be wrong. I reverted the Chapter 11 to 7 edit because I could not find a reference for a Chapter 7 case. Second, liquidations can be done under Chapter 11 if the attempt to reorganize fails without requiring a conversion to Chapter 7. Jesse Viviano (talk) 11:25, 10 August 2009 (UTC)[reply]

I was unable to find which title the filed under, but generally you liquidate under Chapter 7 only. Rarely, you "reorganize" by liquidation, normally you convert to Ch 11. But Chapter 7 is for liquidation only, and both Ch 7 & Ch 11 can be voluntarily or involuntary and that more controls what goes on, i.e "The difference between Ch. 7 and Ch. 11 is who controls the liquidation. Under Ch. 7, the bankruptcy court controls it. Under Ch. 11, the debtor's management controls the liquidation." is incorrect. Aboutmovies (talk) 07:15, 11 August 2009 (UTC)[reply]
When a business files for Chapter 11, it usually tries to reorganize. Liquidation under Chapter 11 usually is performed when the effort to reorganize fails. This happened with Circuit City. However, Chapter 11 has also been used to buy time for litigation like in SCO Group's case (almost everyone who knows of this sham wishes that the effort by the U.S. Trustee to convert this to a Chapter 7 succeeded), to buy time for a sale to successor businesses like in General Motors, or to wait for better deals to come for very illiquid assets or to allow them to mature, like in the case of Lehman Brothers. I'm not getting your point. Chapter 7 (as indicated by its title in the USC) is for liquidation. Chapter 11 (as indicated by its title in the USC) is for reorganization. Within Chapter 11 there are many provisions for converting to Chapter 7 at the request of the debtor, or the creditors, or if it will give the best deal for the creditors, all depending on the circumstances. On rare occasions do you liquidate under Ch. 11 (that's why there is Ch. 7 titled liquidation), and Circuit City did not, they converted to Chapter 7. And yes, bankruptcy and the threat of bankruptcy are used as bargaining chips. With GM, the partial sale to a new company and the removal/conversion of debt was re-organizing, and then they emerged from bankruptcy. Re-organization can be getting a better deal on your interest rates, selling off assets/divisions, selling off the entire company, or in rare occasions the liquidation of the assets (as happened with Joe's). New company[edit]

While certainly a mention of the company is warranted, but they would not be a successor in interest and as such would not be a "Resurrection". Plus, after only five months in existence and one major newspaper article, the coverage needs to be kept in proportion to the long history of the original company. If their new company becomes a success and they receive more media coverage, then we can add more and think about starting a new article for it, but we are a long ways off. Joe'sG.I. Joe's – Restoring original page name over redirect. The chain's name was G.I. Joe's for 55 years and Joe's for only its final 2 years. The first name will therefore always be by far the most common name by which the chain is known, remembered and historically referenced. I tried to move the page myself, because I doubt anyone would object, but unfortunately could not, because the target (article's original name) has 3 edits, due solely to one erred edit that was quickly reverted (and I'm not an admin.).
