British claim[edit]

The British Government claims that British National (Overseas) passport holders enjoy the same level of consular service in third countries (outside the UK and PRC) as other British Nationals. [1]

So the UK government claims that. What do other EU countries claim? There's a rule saying that EU citizens may enjoy consular protection from embassies and consulates of other EU countries, at least if there's no embassy or consulate of the own country anywhere nearby. So British citizens residing in the UK can go to, say, the French or the Dutch embassy, and gain protection there. Can BN(O) citizens also gain protection from French and Dutch embassies? In short -- No. My understanding is that BN(O) passport holders are not entitled to consular assistance from other EU countries. This is because, unlike British Citizens (BC), people with BN(O) status are not EU citizens - as is clear from the fact that the BN(O) passport, unlike the BC passport, does not state "European Union" on the cover. The BN(O) status was created to provide a continuing British commitment to former Hong Kong BDTCs when the latter status automatically expired after the 30 June 1997 transfer of sovereignty. The BN(O) passport is a legacy of the British Empire - it is a specifically British government commitment - and other EU countries have no consular obligation towards BN(O) passport holders.--Whimsical Oracle (talk) 23:53, 7 July 2009 (UTC)[reply]
