I believe the {{badfairuse}} tag does not apply here. The image was distributed by Getty (and other agencies), but its actual source is the Tamil Tigers, who made it as a propaganda photograph and distributed it to journalists. The photograph is therefore not a commercial photograph, is at any rate not copyrighted by an agency, and since the Tamil Tigers are defeated or outlawed everywhere, its reproduction here does not infringe on any commercial use. It is therefore not appropriate to speedy delete this single image we have of this notable dead person. If its fair use is contested, a deletion discussion should occur.  Sandstein  21:35, 22 February 2011 (UTC)[reply]

Agreed. According to this article the image is an "LTTE handout" and merely distributed by AFP. The fair use justification seems reasonable. I've removed the speedy tag, and I suggest WP:PUF would be the best place to discuss it if anyone still believes this should be deleted. Thparkth (talk) 18:09, 23 February 2011 (UTC)[reply]
