Ownership of this image

Without getting into arguements about copyright law, the original of this image appears to reside at the National Gallery of Scotland, and they do appear to assert ownership rights to the image, since they claim to offer it under Creative Commons license. So it would probably be unwise to use it as if it were not subject to copyright.
