JdH had an email exchange with Dr Bernhard Nunner, Chief Executive of the Deutsche Physikalische Gesellschaft about the copyright status of this picture, see below.
The best hope to resolve the copyright issue may be the Max-Planck-Institut für Wissenschaftsgeschichte in Berlin, see Max Planck: Praeceptor Physicae. Perhaps somebody is interested to write to Jörg Kantel to ask him about it? JdH 18:47, 8 August 2007 (UTC)

Dear Dr Nunner:

I am writing you to find out about the copyright status of a well known picture of Drs Max Planck and Albert Einstein. The picture I am talking about is posted on the website of the Landesmuseum für Technik und Arbeit in Mannheim, see http://www.einstein-begreifen.de/presse.html It is the third picture on that webpage, with the caption "Max Planck überreicht Albert Einstein die »Max Planck-Medaille« am 28.06.1929". This truly is a unique picture of these two great men of science, and we would like to use it for Wikipedia, see, http://en.wikipedia.org/wiki/Max_Planck
However, concerns were raised about the copyright status of this picture, because conflicting claims of copyrights can be found on the internet. I did ask the folks of the Landesmuseum für Technik und Arbeit about what they know about copyrights, but up to now they have not been able to clarify this.
Based on the fact that this picture was taken during an event of the Deutsche Physikalische Gesellschaft I thought that perhaps the DPG owns the copyrights of the picture. Could you verify whether that is indeed the case, and if so whether the DPG would grant permission to Wikipedia to use it? Or, perhaps it is now in the public domain, since it was first published more than 70 years ago?

thank you very much for your email. First, I have to apologize for the delay until this answer. After our spring meetings I had a huge pile of new emails to answer.

This is indeed a well known picture since it was the first Max Planck Medal awards ceremony in 1929. More information on the Max Planck Medal: http://www.dpg-physik.de/dpg/preise/preistraeger/max-planck-medaille.pdf

DPG also has only *a copy* (a print) of this picture and not the copyright. I don't know about the copyright situation.

The Hebrew University in Jerusalem has the rights on most of the Einstein heritage, also for almost all Einstein photos, pictures and texts.

Indeed, you should be careful not to use photos with unclear ownership of copyrights.
