Original publication: It probably was published earlier but appeared in print as early as 1967-68 in G. Hla Maung's "On International and Burmese Painting" published in Burma.

Immediate source: The Burmese art scholar U Min Naing gave the photo to me before his death in 2004.

In the w:#Editing Wikipedia: Media Copyright Questions (section) I enquired about this file and was referred to the following section this section where Burmese copyright law is explained.. Commons states that photographs in Burma are in the public domain "50 years after the date of the making of the original negative from which the photograph was directly or indirectly derived." Because Saya Aye died in 1930, this photograph must be in the Public Domain in Burma.

This work formerly was copyrighted in Myanmar but is now in the public domain because its term of copyright has expired (details). According to the Law No. 15/2019 of May 24, 2019 of Myanmar (English translation from the Myanmar Law Information System):
  1. This is an audio-visual and cinematographic work, and 50 years have passed since the year of its creation (that is, the work was made before 1974)
  2. This is an anonymous or pseudonymous work, and 50 years have passed since the year of its creation or publication (that is, the relevant action was done before 1974)
  3. This is a work of the government and 50 years have passed since the date when the work was published or first made available to public (that is, the relevant action was done before 1974)
  4. This is a work of applied art and 25 years have passed since the year of its creation (that is, the work was made before 1999)
  5. This is another kind of work, and 50 years have passed since the year of the author's death or last-surviving author's death (that is, the death occurred before 1974)

You must also include a United States public domain tag to indicate why this work is in the public domain in the United States. Note that this work might not be in the public domain in countries that do not apply the rule of the shorter term and have copyright terms longer than life of the author plus 50 years. In particular, Mexico is 100 years, Jamaica is 95 years, Colombia is 80 years, Guatemala and Samoa are 75 years, Switzerland and the United States are 70 years, and Venezuela is 60 years.

This non-U.S. work was published 1929 or later, but is in the public domain in the United States because either
  • it was simultaneously published (within 30 days) in the U.S. and in its source country and is in the public domain in the U.S. as a U.S. work (no copyright registered, or not renewed),

or

  • it was first published outside the United States (and not published in the U.S. within 30 days) and

  • it was in the public domain in its home country on the URAA date ( January 1, 1996 for most countries).

This work may still be copyrighted in other countries.
