Summary[edit]

Fair use for Jack Sparling[edit]

Though this image, which I have myself scanned from the original art for the Claire Voyant comic strip (dated July 27, 1948), is subject to © by Chicago Sun-Times its use here is regardless covered by the U.S. fair use laws because:

  1. The panel image representatively illustrates an educational article about the comic strip's artist, Jack Sparling; its inclusion in the article adds significantly to understanding the text because it is a historical sample of the Sparling art covered in the critical commentary, and features the title character of his noted work. Therefore the image substantially improves the educational value of the article.
  2. The image is used as the primary means of visual identification of the article topic, which directly concerns a visual art.
  3. It is of much lower resolution than the original, and two panels only are shown. Any potential copies made from it would be of very inferior quality and unsuitable for any commercial purpose. The image is not used here for profit, and its use on Wikipedia does not compete with the copyright holder, United Features, and such use does not decrease the value of the copyright to its holder.
  4. It is not in any way replaceable with an uncopyrighted or freely copyrighted image pertinent to the work referenced in the article, because the whole body of work under discussion in this section of the article is © Chicago Sun-Times.
